The State of Georgia does not allow common law marriage to be entered into in Georgia after January 1, 1997, but common law marriages which were entered into in Georgia prior to that date will be recognized. Let’s go over Georgia Marriage requirements.
To be a valid marriage in Georgia, there must be 3 conditions which are met. The conditions are:
- Parties able to contract
- An actual contract, and
- Consummation according to law.
In order to get a divorce, the parties must have a valid marriage.
